This morning Elite Recovery suddenly shut down, 70 people were told to leave the premises. No warning, no notice. Collections have been thin, but this was unexpected.

Earlier this week, CSGA in Columbus folded, Bronson & Migliaccio are ready to file for bankruptcy. Redline Recovery and LHR are laying off large numbers. I dont know if I can make it through the season at this rate.

Does this clear up with the new administration or do I make the smart move and look for work in another industry? I hate to throw away 4 years experience, but man, this is scary.

I had a friend at Unistates/First American got laid off last month. It seems like that started the ball rolling. Who's next on the list of failed agencies?

Everyone in WNY is nervous right now Tornado, the First American/Unistates bankruptcy filing sent a shockwave throughout the area. NCO and Creditors Interchange are pink slipping this week, expect to see a lot of small players gone by the new year. This is like Wall Street dejavoo, a domino effect on the area. Who wudda thunk it just six months ago?

Yeah I know - six months ago I was hitting bonus and walking the floor part time instead of having to spend 8 hours on the phone - it was great. The paper got awful thin around October and management started "suggesting" stronger tactics on the phone. I wouldn't have given some of these accounts to my worst enemy, (lots of OOS stuff, a bunch we decided had been culled by at least one other team in Buffalo).

I think our situation at RLC had to do with inability to finance new paper, but who knows for sure.

Bill collectors aren't exactly known for their genteel ways.

Take the case in which a collection agency telephoned a woman's 5-year-old daughter, ordering her to tell her deadbeat mommy that she'd better pay her credit card bills.

"Another customer had 12 messages at the office in one weekend. Another had 36 calls in one week," said David Sumner, senior deputy attorney general with Pennsylvania's Bureau of Consumer Protection.

Such tactics are considered harassment and violate state and federal regulations intended to protect consumers from overzealous debt collectors, he said. Abusive practices such as repeated phone calls or the use of threatening or obscene language also continue to sully the debt collection industry, Mr. Sumner and other regulators say, even though a majority of collection agencies are reputable firms that work within the law.

"We believe the mistreatment of consumers by debt collectors is a serious problem," said Tom Kane, an attorney with the Federal Trade Commission's division of financial practices.

Complaints about debt collectors have risen in recent years at the state and national level, both in absolute terms and as a percentage of overall complaints. Still, it's hard to know if the increase is because bill collectors are getting worse, or simply because more people are complaining.

In Pennsylvania so far this year, the consumer protection bureau logged 3,240 complaints about debt collectors, the most of any industry. The tally outpaced the broader categories of telecommunications (second with 3,155 complaints) and buying services (third with 2,827), a segment that includes such things as gift certificates, coupons, rebates and contests.

While some gripes come from people searching for a loophole to skirt their debts or who simply don't like being reminded they owe money, many complaints are prompted by bill collectors stepping over the line, regulators said.

Sometimes, the problem lies with a "rogue" employee at an otherwise reputable company.

"If its an upright company, it will discipline the employee or let them go," Mr. Sumner said.

In Pennsylvania, complaints are often about bill collectors calling too often or taking aggressive actions, such as contacting a neighbor, relative or boss to pressure payment, Mr. Sumner said.

Under state law, which essentially mirrors federal regulations, debt collectors generally can't discuss the debt with anyone other than the debtor or the debtor's attorney.

Bill collectors also can't use threats of harm or obscene or profane language, and may not contact the debtor before 8 a.m. or after 9 p.m. or use the telephone to annoy.

Collectors also are prohibited from making false or misleading statements, such as implying that the debtor will be arrested, or that the creditor will file a lawsuit when it can't or doesn't intend to do so.

Threats about garnishing wages also often violate the law, Mr. Sumner said, since the state allows garnishing in only special cases, such as for child support and back taxes.

Experts advise consumers contacted by a bill collector to write a letter requesting verification of the debt. Mistakes are made, so the collection agency simply could have the wrong person.

"I pity the John Smiths of the world because they probably are getting collection calls for other people," Mr. Sumner said.

Consumers who don't believe they owe the money should dispute the claim by certified mail within 30 days of receiving the collection notice.

Consumers also can stop a debt collector from making further contact by writing a so-called "shut-up" notice demanding that communications cease. The approach doesn't make the debt go away, however, and could push the creditor into suing.

"That's a powerful tool, but probably best used when the consumer doesn't owe the debt," Mr. Kane said.

Consumers who believe they've been victimized by a debt collector can file a complaint with the state consumer protection bureau or the FTC, which rely on tips to build cases against offenders by establishing a pattern of abuse.

Consumers also have the right to sue within one year of the alleged violation.

Of course, many problems can be avoided by contacting creditors directly to work out a repayment plan at the first sign of having difficulty paying a bill.

Even so, consumers who fall behind shouldn't have to endure lies and abuse, regulators said.

"We expect companies to be reasonable in their debt collection activities. We don't want to hear they are harassing people," Mr. Sumner said.

"It's a legal business and they serve a role. We're just asking that they comply with the law."

I have been given the honor of guest authoring a blog entry on Normie's blog dedicated to exposing CREDITWRENCH CEO Billie Bauer for the con-man and scam artist that he is.

Normie, the following post may be a bit lengthy for your blog, so you are welcome to edit it as you feel is appropriate:

The first proof of a con job is that it always starts with a lie. Ithere was no conversation between this known and wanted criminal and Creditwrench CEO Billie Bauer today, October 14, 2006. This Bil-LIAR was told to start his so called post by another scam artist who claims to have a blog that is the worlds #1 for something or other but in fact is never read by anybody other than his debt collector buddies, all of whom are known and wanted criminals. The proof of what is said by me is posted on another blog.

Once a person is proven to be a liar then nothing else he has to say is important because it will all be nothing but more lies.

Mr. Bauer claimed that consumer reporting agencies (Experian, Trans Union, and Equifax) search court records for civil money complaints that have not yet been tried,

This is also a lie. It was also not stated anywhere that the credit bureaus search court records for civil money complaints that have not yet been tried. What was said is that judgments sometimes show up on credit reports even though they have not yet been tried. The fact that a judgment has been filed can and sometimes does show up on credit reports.

Somehow, this scumbag seems to think that just because he is a debt collector people are going to take whatever he says as the truth, the whole truth and nothing but the truth. The sad fact is that debt collectors are known to be liars, cheats, thieves and general all around scumbags. Lest anyone doubt that fact just look around the internet and see what honest hardworking Ameicans have to say about them.

And if that isn't good enough then just look at the multitudes of newspaper articles by reputable journalists and radio or TV stations have put out about these criminals.

And if that isn't good enough then you should stop and ask yourself why is that so many states have had to pass laws requiring debt collectors to post huge bonds and get state issued licenses to collect debts in their respective states?

The reason is that so many debt collectors have collected huge sums of money for banks, merchants and credit card companies and never returned money to those companies who trusted them to deal with them fairly and honestly only to find out they were being cheated out of tons of money or not being paid at all.

Even that hasn't been enough to stem the tide of thievery so the bigger banks and credit card companies have stopped referring their delinquent accounts to debt collectors long ago and now only sell their receiveables to large buyers capable of buying many millions and even billions of dollars worth of delinquent accounts in bundles at a time. They are known as brokers and their business is to buy in bulk and break up the bundles and sell them to the smaller companies in bundles they can afford. And of course, they make huge profits with little or no risk because there is always somebody out there willing to buy those little bundles in the hopes of getting rich by making your life miserable.

So now you know the whole story. Never, Never, Never trust a debt collector any further than you can throw him. And never, never, never believe anything they say on the internet or off of it because you will be fed a line of bull if you do. The only thing they know how to do is prey on your gullibility.

This is completely false since such an action would effectively deny the consumer the right to due process of law to have the complaint tried in court and determine if there is any liability by the consumer to pay the debt at all.

This isso obviously wrong that it isn't even funny. Debt collectors often attempt to effectively deny consumers the right to due process of law but there is no possible way that the appearance of a judgment on a credit report would deny the consumer the right to have the complaint tried in court to determine if there is any liability by the consumer to pay the debt at all or not. Neither judges nor juries pay any attention to what a credit bureau might have to say about a defendant's liability or lack of it. Once again, this criminal is proven to not only be a liar but now proven that he knows nothing about the law at all or how it operates. Yet he expects, no, demands that you accept whatever he says as being the truth, the whole truth and nothing but the truth. But the truth is that everything he has written is a total fabrication and that he has no knowledge or understanding of anything.

Additionally, the false reporting of a debt as a Judgment on a person’s credit bureau report when in fact the matter has not yet been before a judge, is a clear violation of the FCRA and FACTA.

Another loony tune. Credit bureaus and debt collectors alike scoff at the law routinely for the simple reason that they make untold millions of dollars doing so and if the poor debtor wishes to complain about it he has to file a lawsuit which in federal court costs $350.00 up front which is a sum of money that many simply can't afford even if they could find a knowledgeable and competent attorney to take the case. So they normally get away with anything they want to get away with.

After all of the proof above that what you may have read or may contemplate reading is nothing but false and mis-leading information, nobody really needs to know much more than that.

People who author blogs and other online material are expected to publish accurate information and if they don't then they suffer by reason that nobody pays any attention to what they have to say nor even bother to visit the website or blog.

That's why the blog that is being touted as an expert source of information has no visitors other than other debt collectors. One visit is more than enough to cause you to understand that it all a bunch of hooey.

And then he threatens reprisal by murder again.

First he posts a file showing where he got sued in Utah for defaming another company and falsely using their good name or variations of it and claims he just found it. Here is the caption of the case he purportedly "found".

You will notice that one of the trade names used by Paisola is Global Media Domain Trust, a Singaporean business entity. Another of his false identities, Creditwrench-thetruth, calling himself "consumer_advocate" registered on the CREDITWRENCH MESSAGE FORUM on Saturday, October 07, 2006 at approximately 1:30 P.M. using the email address consumer_advocate@singapore.com and using an I.P. address that actually traces back to Singapore posted a very large amount of spam advertising his scam blog at creditwrench-thetruth on blogspot.

His next move was to go over to pcmholdings.com and post the following:

A recent furor has erupted about whose version of the new FDCPA rule
changes is the correct version.

The Creditwrench message forum first exerpted portions of the proposed
new FDCPA changes which was taken from the Kaulkin-Ginsberg press
release which loudly proclaimed their participation and effectiveness
in getting the new legislation passed into law. Creditwrench obviously
knew that the Kaulkin-Ginsberg release had to be false and misleading
and his purpose was to expose that fact.

Later, a pediantic moron who calls himself "creditwrench-thetruth"
posted equally putrid garbage about what he claimed to have obtained
from the Library of Congress but was also full of false and misleading
information as usual.

The correct version, also later posted by creditwrench on his forum and
herein copied from the creditwrench message board and the Thomas
Library follows.

802. Other Amendments
This section makes amendments to the FDCPA. These include:
(1) a clarification that formal pleadings are not initial
communications;
(2) an exception to the definition of initial communication for forms
or notices that do not relate to the collection of a debt and are
required by the Internal Revenue Code of 1986, Title V of the GLBA, or
Federal or State law relating to notice of data security breach or
privacy; and

(3) a clarification that debt collection activities and communications
may continue during the 30-day validation period as long as they do not
overshadow or are inconsistent with the disclosure of the consumer's
right to dispute the debt or request the name and address of the
original creditor.

Now then, as can be seen by checking the differences between the actual
wording of the bill and the hype and hoopla put out by
Caulkin-Groansberg and their ACA (American Criminals Association)
things are not quite as they would like consumers to believe that they
are.

Caulkin-Groansberg put out their gagrag article loudly proclaiming how
much good they had done for their "hood" by working closely with
legislators to get the new revisions to FDCPA passed in order to
lighten the burdens put upon the collection industry by an old and
outmoded FDCPA which sorely needed revamping.

Looks more like hogwash to me. As can be readily seen, they just
reported the first part of the legislation but didn't talk about the
part underlined in red above. It is that latter part in underlined red
type that is the actual key to the whole thing. They can't overshadow
in the process in anyway and what constitutes overshadowing has already
been well defined by numerous court decisions.

It also puts the further burden on them which is that their actions may
not be inconsistent with the disclosure of the consumer's right to
dispute the debt or request the name and address of the original
creditor.

What it looks like to me is a ready made trap for the overzealous
criminal rather than bringing any great new benefits to America's Most
Wanted Criminals.

What we will have to do is to be certain that we are more keenly
attuned to exactly what is and is not overshadowing or what may or may
not be adjudged to be interference with our right to dispute the debt
or any portion thereof.

What is also inherently obvious in the comparison between the
Caulkin-Groansburg gagrag version and the actual wording is that C-G
did not read or comprehend the full text but rather in it's rush to
publish rubbish chose to ignore the real truth of the matter in order
to further enhance their bragging.

consider the source, we would expect nothing less. Either way, there
are no really essential changes in the wording of the two versions. The
only real difference is in the original caulkin-groansberg press
release version which just goes to prove that you can't believe
anything a debt collector or anyone associated with a debt collector
says.

Gramm-Leach-Bliley Act , or any provision of Federal or State law
relating to notice of data security breach or privacy, or any
regulation prescribed under any such provision of law, shall not be
treated as an initial communication in connection with debt collection
for purposes of this section.'.

(c) Establishment of Right to Collect Within the First 30 Days-
Section 809(b) of the Fair Debt Collection Practices Act (15 U.S.C.
1692g(b)) is amended by adding at the end the following new sentences:
`Collection activities and communications that do not otherwise violate
this title may continue during the 30-day period referred to in
subsection (a) unless the consumer has notified the debt collector in
writing that the debt , or any portion of the debt , is disputed or
that the consumer requests the name and address of the original
creditor. Any collection activities and communication during the 30-day
period may not overshadow or be inconsistent with the disclosure of the
consumer's right to dispute the debt or request the name and address of
the original creditor.'.

The real truth is that no version has any validity until it is signed
into law by the president and even then sections of it may be
overturned by the Supremes at any time although it is highly doubtful
that the Supremes will have reason to find fault with any of the above
wording.

Another point is that this isn't the full version of the bill by any
stretch of the imagination. These changes are a very small section of a
much larger bill that mostly deals with banks and banking institutions
and gives them much greater freedom in setting up new branch banks and
lessens the paperwork burdens on the banks when reporting to various
banking and banking related agencies. Some sections also make changes
to GLBA and the requirements about who must send out those yearly
privacy notices previously demanded by GLBA.

Although most of us have not been paying attention to GLBA and those
yearly privacy notices that have been required and even some banks
still do not have the right information nor have they ever complied
with the original requirements of GLBA. Many banks are simply handing
out or mailing out a privacy notice to their new customers at or
shortly after opening a new bank account then never again.

So this isn't just about FDCPA but rather a whole range of financially
related law.

We aren't really going to have reliable information until it is signed
by the President, becomes actual law and has been distributed to the
public and even then we will have to guess how the courts will rule on
various cases before we can really get the whole case law on the new
changes.

Anybody with any common sense at all will instantly realize that he can't possibly back up that boast. And that alone should be more than enough to warn anybody that anything on that blog is likely to be just as false and misleading and if they actually do go there they will quickly realize that fact.

Half truths and outright lies made to look like there might be some truth to it.

And your own statement above tells the whole story. You and your pals are debt collectors and you full well realize that anyone or anything that threatens your livelihood and your industry must be dealt with in anyway possible.

My public statement(s) that debt collectors are actually America's most wanted criminals is one that is starting to get an great deal of attention here on the internet and probably lots of other places as well. While that may seem a pretty far fetched statement in itself at first glance, let's examine the logic behind it and see just how far fetched it is.

1. According to many quotes including those put out by various members of the collection industry and the press there are more than 150,000 people working in the collections industry today. Some sources now say more than 162,000 people are employed in the collections number and most sources say that number is growing every day. Most likely the truth is that nobody will ever be able to know exactly how many are employed as debt collectors at any given time.

2. Most of those so employed actually break the law(s) in one way or another each and every day. Their infractions may be great or they may be pretty minor, simple mistakes of omission that anyone might make anytime, but violations none the less.
Some of those violations are extrememly serious such as failure to pay creditors for money collected from debtors. Stealing money from their employers in other words. Many of those so employed are actual criminals with prison records or long arrest records for whatever felony crimes they have committed. It makes no difference how you break the law or how serious the violation is or whether or not the violator was caught and convicted of anything, he is still a criminal if he breaks the law.

Debt collection companies have no qualms about breaking our laws because the chances of getting nailed for it are slim and even if they are caught and fined the fine is of such a small amount that it amounts to no more than a slap on the wrist. Even a fine of $1.5 or so million dollars is nothing to a company like NCO or ALLIED or Sherman Acquisitions or any of the large agencies who make a lot more money than that. What is a fine of say $1.5 million to a company making more than $100 million a year? Nothing at all. The only thing that even comes close to hurting them is the adverse publicity and that not much.

3. Debt collectors usually like to hide their physical address or other contact information from debtors and the public. Why? One reason is that when the debt collector calls he don't want to wait for his money. He wants it paid by online check or credit card right then and there. If a debtor wants the contact information he has to dig it out of them and that is often not easy to do.

That "hiding" causes untold hundreds of people to have to hunt them down every day
who actually need and want to pay them off but can't find them to do so. I can easily prove that fact because I have many websites out there such as THIS ONE which is nothing but lists of contact information for thousands of collection agencies all across America and even some in Canada and other countries. They are compliled into lists alphabetically and by phone number and by the state that they have offices in.

Those websites get hundreds of visits every day and there are a lot of other websites out there with similiar information who are also getting lots of hits.

Law enforcement officials are also out there trying to hunt them down so that they can be brought to justice. I know that to be a fact because I often get calls from various law enforcement agencies from around the country wanting to know if I can help them find some collection agency or other.

4. I say that easily makes debt collectors like you America's Most Wanted Criminals and I think most people who ever had to deal with a debt collector would tend to agree with me when I make that statement.

Most people are not aware of all of the stories about criminal debt collectors and the violations they commit every day. Stories put out by such reliable sources as The Boston Globe, KDKA TV, Channel 6 in Denver and many, many more all across America but I'm starting to put together a compendium of those stories which will be put on a new website featuring all the stories I can find about America's Most Wanted Criminals.

So, by your own admission, we now have the truth about why you, Normie or E. Normis Debtor (or whatever fake and fictious name he chooses to use) are doing all you possibly can to discredit me and make me look like a fool. And if you can do that to me then you can also do the same to all other message boards or anybody who really presents a credible threat to your so called "industry".

In your own words, you, Normie and the rest of your crowd will stop at nothing to defame, discredit, flame or do whatever it takes to put me out of business and then you will obviously move on to do the same to anyone else who tells the public what criminals you and your "industry" really are and how to deal with your abusive collection practices in an effective manner.

You have tried to do the same to Bud Hibbs and are continuing to do so and you are trying to do the same thing to a few others, most of whom present no real threat to your "business."

But the truth hurts and it will keep on hurting because what you don't seem to realize is that the only thing that will keep me from effectively telling the story about the industry is for you to actually come to Oklahoma City, put a gun to my head and pull the trigger and it would probably surprise nobody to learn that you have actually threatened to come to Oklahoma City and "pay me a little visit". There have been other such statements on your PCMHOLDINGS.com forum as well, probably also by you and your other false screen names.

So if I turn up dead one of these days it will surprise nobody at all. But your problem is that I'm not going to go away until the day I die. No amount of false and misleading statements about me is going to change the fact that you can't win the battle. My words will remain long after I am dead and gone too and you can't break me financially either no matter what you do.

The only way to win is to clean up your industry and you don't have the power to do that either.

So just keep on with your slimy tricks and bad mouthing me. Most people are getting the message no matter what you do or say.

For most companies, their placement in search engines is important. Indeed, today good placement in search engine listings is vital to the success of almost any business.

But it is not only important for a company to be in the top positions for the keywords and keyword phrases that pertain to their industry but it is also extremely important what the listings of others have to say about your company. Having a top listing in the search engines with your company blurb there for everyone to see is important but if most of the other listings have negative things to say about your company and the page or pages you are on are filled with derogatory information your top listing will do you no good at all.

Kalkin Ginsburg who has the website known as collection industry dot com has hired a new webmaster to oversee their forum and it is obvious that Mike Bevel has taken their forum to a new level by getting rid of most of the derogatory comments made by posters about other web sites and blogs. Their public image has soared as a result and it has done so very quickly.

Their listings on Google and other search engines has been cleaned up and is looking great and is obviously the result of the excellent webmastership of Mike Bevel.

The obvious lesson to be learned is that if your forum engages in flaming or bashing others your own rankings will suffer as a result.

Spam messages that are off-topic and only promote someone else's products or services in any way should also be deleted from your forum as fast as they appear and their authors should be banned from your forum. Their off-topic postings can only harm your business and your rankings in search engines.

New credit history scam.

What you need to know: Not legally. Some firms will try to get customers to apply for new taxpayer identification or Employer Identification Numbers (also called an EIN) for the purpose of building a new credit history. It's a felony, says Ridout.

But the reason people get taken is that con artists don't explain the whole scheme, so consumers don't realize what they are being asked to do. Consumers also may not know that getting a new number to create a new credit history is illegal. And the whole concept is based on faulty reasoning, says Ridout. Since the new file will list the same name and address, it would still have all the same information and history, even with a new number.

Beware if anyone talks about getting you a new credit file, file segregation or a fresh credit history.

-- and one of the most costly. Con artists dangle the promise of much-needed money or loans in front of desperate consumers as an incentive to pay, pay and pay. Some scam outfits mimic credit counseling agencies, others imitate mortgage companies. But all they do hit you up for money (sometimes several times) then leave you empty-handed.

And since there are genuine community nonprofit groups that help educate consumers and help with affordable housing issues, scammers may also try to imitate that business model. The best advice: Hold onto your wallet, and be wary of any big promises or fast fixes. Reputable organizations focus on education. When in doubt, do a little reference checking on the Internet, with the state regulatory or consumer offices and with local offices of nonprofits and community groups you trust.

Uncle Normie looses again.

The infamous Twatlooser who calls himself "The-Duke-of-Prunes" and "Uncle Normie" and an untold and unknown number of other false screen names trying to hide his true identity just got nailed this morning after providing false and misleading information to the FBI about CREDITWRENCH.

What the 27 year old single male nitwit from San Diego did was to claim that Creditwrench CEO Bill Bauer was actually a wanted man on the lam from Boston Police for Rico violations.

So an investigation was launched by the FBI who knocked on Bauer's door this morning wanting to see if the report was true or not.

They were pretty edgy until Bauer opened the door and then they could plainly see for themselves that they had been scammed into making an investigation based on false information.

Bauer taped the conversation and provided a copy of the recording to our investigative reporter for reproduction here.

Bauer reports that once the excitement settled down and he told the agents that this was obviously a false report knowingly provided to them by the California nitwit they were only too happy to allow him to file a complaint against the person who filed the false report.

The Duke of Prunes may not be around for much longer.

It depends on the contract between the new owner and seller. It is most likely the new owner will own all liabilities (your back rent) as well as the assets (property). I doubt you would be given a new lease if you are currently in arrears (I wouldn't) Nothing personal just business....... It wouldn't be beyond the realm of possiblities your one year new lease would include the back payments in your new rent agreement but you will want to keep in mind the arrearages can blow up on your credit report and you could have additional liabilities of you don't perform on your lease (not fulfill the term). Sounds like your current landlord is a candidate for sainthood.

An additional problem is that Fair Isaac, Trans Union and Equifax are not clear about WHICH dates they are using to age collections and charge-offs.

I would greatly appreciate any letters from collection agency and creditor executives in support of changes to credit scoring and reporting practices.

Mr. Shannon advised me that OSI has absolutely NOTHING to do with NCO. "They're like Burgerking and McDonalds."

I asked why their collectors didn't tell me that and he replied: "We have offices in 26 states with 7,000 employees and 26 million accounts and a minimum wage collector has no idea about the internal operations of our company."

Does anyone else think it's strange that collectors don't know what company they collect for?

Nevada Legislature passes new collection laws

The Nevada Legislature recognized a lack of responsibility with respect to some companies trying to get payment for overdue accounts, including abuses by collections agencies and collections agents.

Unlicensed and unregulated companies acting unlawfully in a collection agency capacity could be impacted by new legislation (some in effect as recently as Oct. 1) that places additional requirements on the agencies homeowners associations retain to collect for them.

The law also determines who is qualified and able to conduct collection services for common-interest developments.

Essentially, the Legislature is regulating the need for more responsibility in the overall collections process for common interest communities.

Under NRS 649, now in effect, any entity acting as a collection agency must have a "collection agency license." There can be significant negative repercussions to entrusting your company's important legal and financial business to non-licensed vendors.

Under state and federal law, acting unlawfully as a collection agency without a license can result in the office being shut down by the state and, in some cases, can result in fines in excess of $10,000 per violation.

Even if you are a company handling collections in-house and feel the new state law does not apply to your situation, you must still ensure that you are in compliance with the Fair Debt Collection Practices Act.

This statute is an entire body of federal law that dictates how a collection agency shall conduct business. Failure to comply with the FDCPA can result in penalties of $500,000 or 1 percent of the net worth of the debt collector.

There are many statutory requirements for a collection agency or manager to maintain a collections license. Nevada's Senate Bill 325, which came into effect on Oct. 1, contains amendments to NRS 116, including significant changes in the format, style and procedure of collections.

Seems like I have a penchant for getting debt collectors mad.

The fellow in the following link is a debt collector. I do have his name and his home phone number and his actual address and it is a matter of public record. His name indicates that he is of Italian Descent and that he lives in the NorthWest part of Atlanta, Georgia and in the zip code of 30152. And yes, I do have his verified actual home address.

This guy is making some real serious threats and using some extremely obscene language in stating exactly what he plans on doing to me. So if you have tender ears then don't click on the link and don't click on it when there are minor children around who might be able to hear it. The language he uses is extremely vulgar.

The only good part about it is that the police will be able to track him down easily and put him behind bars where he belongs. This is the official complaint number which I filed with the Oklahoma City Police department.

Debt Collectors caught like a rat in a trap.

Minnesota Attorney General Mike Hatch's office is alleging that a large metropolitan area collection agency is blocking an investigation by refusing to turn over documents.

The attorney general's office has asked a judge to force the Messerli & Kramer law firm, which operates the collection agency, to respond to information requests, including names of consumers who might have been harmed by the agency's practices.

Hatch's lawsuit in December alleged that the Plymouth-based collections operation deceived and harassed low-income consumers over debts and presented misleading information to courts during legal actions against them. Hatch said more than 1,000 people may have been subjected to such tactics to collect on unpaid credit card bills, car loans and other debts.

As part of the motion filed Monday, Hatch's office included more than 20 additional examples of consumers that it said had been harmed by Messerli & Kramer's collection practices.

Although collection agencies are allowed to contact debtors, they cannot continue to pursue collection on consumers who inform the collector that most of their income comes from Social Security, public assistance or other exempt income sources.

Messerli & Kramer declined to comment except to say it would respond in court.

Going to Dallas this weekend.

I'm planning to go to Dallas this weekend (Sept 16th-18th) to attend the Richard Cornforth Seminar which will be held at the Holiday Inn Select Central.

I'll be leaving Oklahoma City on Friday about 8 a.m. and should get into Dallas in about 4 to 5 hours depending on lots of things I can't foretell. (LOL)

Its about 3 hours 45 minutes actual driving time so not counting possible flat tires or whatever, I'd ought to make it about noon or so.

There is a group supper at the motel Friday night so I'll be attending that as well.

Most of you won't even know I'm gone because I'll be available by phone at all times and I'll be on the internet via cellphone or wireless network at least some of the time.

I'm hoping to meet anyone coming to the seminar or living in the Dallas area that would like to visit with me while I'm there.

Don't know where I'll be staying as of yet. Might not know until I get there.
I really can't afford to spend the $89 a night to stay at the Holiday so will probably look for something cheaper than that.

The Richard Cornforth Seminar "How to beat up on Debt Collectors" was held at the Dallas Holiday Inn Select Central and was a great success. Richard's topic covered his new book, "THOU TEACHETH MY HAND TO WAR". The seminar was attended by about 50 people and we all had a good time and listened to Richard Cornforth and other speakers, some of whose pictures appear here.

The Seminar kicked off with a nice supper and then we listened to Richard Cornforth make his opening speech before retiring for the night. Richard called for donations to help with advertising costs in order to raise attendance at future seminars and more than $1,000 was donated by attendees.

An old adage has it that there is no honor among thieves. Here is another proof of that old statement. Most readers of my coments will agree that there are many ways to steal. Many will also agree that while making a profit is the norm in all parts of the world debt collectors often steal from both their clients and consumers in a large variety of ways, often trying to force people who don't even owe the debt in the first place to pay for those who do owe the debt.

As a side note to this issue. I HAVE the title, and the original disc of accounts when purchased. I have never been paid by PLR or Mike Kolidan. I have voice mails, legal letters sent by him (claiming to be an attorney but not), I have the title to the file and still have not been paid. I have also recieved a copy of the bill of sale and it is a complete fraud of my signiture. This has been ongoing for months. I have lost my money and Gregs money from the fraud commited by Mike K and PLR.

TO clearify why Greg was involved was becasue he bought the package with me and did haqve rights to the sale of the file. I have learned after 20 years in the biz that once you get screwed by someone like Mike and PLR you will never recover your lost and in the long run get blackballed by others due to their lies.

Please feel free to contaqct me and I will try and help you with the title they could not. I also have many docs and voice mails you may use in court to prove they were aware of the sale being a fraud.

Last as to Mike stating he tried to contact SHeckina and Mike Gallo. Mike Gallow had nothing to do with this file so that was a lie. Mike Gallo have done buisness with SHeckina and also screwed him. I made the mistake in allowing him to fund and agency for me 2 years ago and doing all the work. He has no collection experice and has since had many legal issues his way as to his illegal activitys. THis also I can provide documentation for so beware of buying anything from him and NLRS. They own nothing. I have the contracts and fraus docs to prove this.

FTC Wins $10 Million Judgment Against Fraudulent Debt Collectors

Defendants Permanently Barred from Debt-Collection Activities

The Federal Trade Commission has won a $10.2 million judgment against a debt- collection operation, National Check Control, and its principals – the estimated amount of consumer injury they caused. The amount represents the largest judgment in FTC history for violations of the Fair Debt Collection Practices Act (FDCPA). In addition, a federal district court judge has permanently banned the defendants from engaging in debt collection in the future.

In a complaint filed in May 2003, the FTC alleged that the defendants violated the FDCPA by harassing and threatening consumers with claims that they owed money for checks returned for insufficient funds. The defendants made repeated phone calls, sent threatening letters, and falsely threatened that consumers could face civil or criminal charges if they did not pay the debts. The FTC alleged that, in many cases, the consumers did not owe the money, or owed far less than the defendants claimed. At that time, the court entered a temporary restraining order freezing the defendants’ assets.

In addition to the ban on debt-collection activities and the $10,204,445 judgment, the court has banned the defendants from violating the FDCPA in the future, including harassing consumers with repeated phone calls, obscene language, or threats of legal action; misrepresenting the amount a consumer owes; failing to notify consumers of their right to dispute the debt; and misrepresenting that the person contacting the consumer is a lawyer. The defendants are further barred from selling or transferring any consumer accounts. In order to satisfy the monetary judgment, the court ordered the defendants to turn over all of their assets. It is not yet clear how much money actually will be available for redress.

The final order for judgment and permanent injunction was entered in the U.S. District Court for the District of New Jersey on July 15, 2005.

The FTC received substantial assistance in pursuing this matter from Postal Inspectors from the North Jersey/Caribbean Division; the U.S. Attorney’s Office for the District of New Jersey; and the New Jersey Department of Law and Public Safety. In addition, the FTC would like to thank the following states for their invaluable assistance in investigating this matter and bringing the complaint: Colorado, Idaho, Maine, Minnesota, North Dakota, Washington, and West Virginia.

The major problem with that is that THE WRENCH submitted no such application as is claimed. He continues to devise new methodologies to infiltrate the forum.

A new debt collector's message board was set up a few days ago. Here is the message the posted on the forum telling people how the new board was to be run.
And guess what they did right off the bat!!!! They banned THE WRENCH even though he did or said nothing at all which could have been construed as being objectionable. He didn't insult anybody nor did he try to sell his products or his most excellent services. He even announced that he was not going to get into any arguements with anybody and proceeded to prove it.

Just goes to show you can't believe a word a debt collector tells you. They are like a vicious dog who wags his tail and then jumps up and bites you.

It was probably best stated by in federal court in Sambor v. Omnia Credit Services:

Because Omnia "ceased" collecting the alleged debt, Omnia did not violate the FDCPA by failing to verify Sambor's debt. To hold otherwise, as Sambor would have this court do, would lead to liability under the FDCPA every time a debt collector could not verify a debt. For example, if a credit card company referred an outstanding account to a debt collector and then the credit card company had a fire that destroyed its records, [**24] under Sambor's reasoning, the debt collector would violate the FDCPA because it could never send validation of the disputed debt to the consumer, even if the consumer did, in fact, owe the money. As a result, under Sambor's [*1243] reasoning, a debt collector would essentially have to verify the debt prior to its initial communication with the debtor. Had Congress intended this, Congress would have so stated in the FDCPA.

For Southfield lawyer, civil suit adds to a collection of problems

A civil lawsuit was brought Tuesday against Howard Alan Katz, the Southfield lawyer facing more than 300 criminal contempt of court counts in Lincoln Park for allegedly filing fraudulent court documents in debt collection cases.

The lawsuit, brought by Macuga & Liddle of Detroit, claims Katz, his law firm Katz & Katz and a processes server, Robert Lutren Inc. of Farmington Hills, used the documents to get judgments for overdue bills. They allegedly claimed to have served summons for court hearings when they had not.

The complaint alleges that Katz used the false documents to get default judgments -- that could include the outstanding debt, interest and other fees -- when the debtors did not appear in court.

The debtors allegedly did not know of the judgment until their wages were garnished.

The suit was filed in Oakland County Circuit Court on behalf of two debtors and asks that it be named a class action on behalf of other people victimized by the filings.

"We are looking at a potential class of several thousand people," said David Dubin, a lawyer with Macuga & Liddle. "Mr. Katz had an extensive practice. We believe his actions were denying debtors their day in court."

The civil suit is not part of the criminal contempt cases pending in 25th District Court in Lincoln Park.

Katz's lawyers could not be reached for comment, nor could Robert Lutren.

Also named in the suit were Henry Ford Health System, based in Detroit, and Credit Acceptance Corp. of Southfield. The suit said the health system and Credit Acceptance knew or should have known about the alleged false filings.

In a prepared statement, the health system said: "We are reviewing our association with these collection agencies and those they authorize for services to ensure legal services for collection methods are appropriate."

Angela Williams, a staff lawyer with Credit Acceptance, said the corporation has not yet been served with the lawsuit, but that employees are "working to determine what if anything" improper occurred.

Katz faces trial Sept. 29 in 25th District Court, where Chief Judge David Bajorek brought the criminal contempt charges and seized Katz's bar association membership card.

Katz cannot practice law as long as the judge holds his bar card.

Should IRS use private debt collectors?

Much of what government does is better done with private enterprise, but tax collection is not one of those. Government should collect its own taxes. As stated by Llewellyn H. Rockwell, Jr. in Government Contractors versus Real Business, “It is not privatization to contract out the collection of taxes.”

“Tax farming,” the use of private agents to collect taxes, is an ancient practice. In the U.S.A., Congress in 1872 authorized the Bureau of Internal Revenue to employ private agents to discover and collect unpaid taxes, after the Bureau had been doing so on a small scale without such authorization. Since the collectors kept a percentage of the taxes paid, their incentive was to maximize collections. One of the major collectors padded the accounts with dubious claims, which were accepted by the Treasury Department. The collector went after cases that the BIR was already processing. Even worse, the BIR assisted the private contractor in collecting the taxes! Congress investigated this in 1874 and concluded that this private outsourcing of tax collection served no useful purpose.

Unfortunately, government officials don’t learn from history. Now there is a new authorization for private federal tax collection. Its advocates argue that such outsourcing would increase tax revenues from taxpayers who would pay up when contacted by an aggressive collection agency. Even if they would get a few billion dollars of tax revenue, do we really want private collection agencies to harass us day and night with letters and telephone calls demanding that we pay them taxes allegedly owed?

The U.S. Department of the Treasury’s “Financial Management Service” has a Debt Management Services bureau which contracts with private collection agencies for delinquent tax debt collection. The agency may use administrative wage garnishment to take the alleged tax debt. The employer siphons some of the wages of the employee to the account of the agent to whom the debt is owed.

During the 1990s the IRS used private collectors to locate and contact taxpayers, but not to collect the taxes. The American Jobs Creation Act of 2004 specifically authorizes the IRS to use private agencies to collect tax debts. According to the Federal Daily, a news publication for federal employees, “A provision in the 2005 Transportation-Treasury appropriations bill that would have prevented the IRS from using any funds to contract with private debt collectors to collect tax debts was dropped from the bill.”

Furthermore, “The National Treasury Employees Union (NTEU) has been fighting against tax debt privatization, saying it is dangerous to give private taxpayer information to private sector companies. NTEU President Colleen M. Kelley called the removal of the provision from the 2005 Omnibus Appropriations bill ‘a step backward for consumer privacy’ and ‘a waste of taxpayer money.’ Kelley said NTEU will monitor the IRS’ effort to use private debt collectors, who will be paid a commission on the debt they collect."

The NTEU is correct. The private collection of tax debt creates perverse incentives, especially as the collecting agency keeps a percentage of the taxes paid. Private enterprise is supposed to operate privately! Private enterprise means voluntary enterprise, with willing buyers and sellers. Private firms may properly help a private creditor collect a debt voluntarily agreed to by the debtor. But private tax debt collection authorizes a private agent to help the government use force against a coerced private person.

As the NTEU states, private debt collectors have access to private taxpayer information. Now that identity theft is becoming an ever greater problem, do we want private firms to have such access, including social security numbers and financial account data?

Report: Company will now electronically mask sensitive personal info in aftermath of data breach.

NEW YORK (CNN/Money) - ChoicePoint is changing the way it shares sensitive electronic data in an effort to avoid incidents of security breach that may lead to identity theft, according to a report published Friday.

The Wall Street Journal reported that ChoicePoint (Research), the national provider of identification and credential verification services, will electronically mask sensitive information such as Social Security numbers in its reports and background checks provided to companies on new employees.

The company is also taking steps to severely reduce its business in providing data to private investigators, collection agencies and some small financial concerns, the newspaper said.

Among them, the company said it will restrict the type of information provided to certain small business clients , including private investigators and collection agencies, the newspaper said.

Those customers and "non-bank" financial institutions, such as check-cashing concerns, will no longer have access to reports containing an individual's full Social Security number and similar sensitive information, the report said.

The Journal said the moves come in the wake of thehigh-profile breach at ChoicePoint earlier this year in which criminals posed as legitimate small businesses to illegally obtain data.

The breach has heightened concerns about identity theft -- in which an individual's personal information is used to fraudulently open credit-card accounts or apply for loans -- and helped spur congressional hearings into whether further laws are needed to protect sensitive personal data, the report said.

Data theft involving four banks could affect 500,000 customers
'This thing's getting bigger and bigger,' says one police officer

MAY 18, 2005 (COMPUTERWORLD) - Electronic account records for some 500,000
banking customers at four different banks were allegedly stolen and sold to
collection agencies in a data-theft case that has so far led to criminal charges
against nine people, including seven former bank employees.
Police in Hackensack, N.J., are continuing their investigation into the theft
by a crime ring that apparently accessed the data illegally through the
former bank employees.
According to the U.S. Department of the Treasury, the crime is believed to be
the largest breach of banking security in the U.S., local police said.
Hackensack police Det. Capt. Frank Lomia said the investigation into the
crime ring is moving into a new phase.
"This thing's getting bigger and bigger," Lomia said. "It's still growing.
The banks are uncovering more accounts than we knew about."
The police announced the arrests of the nine suspects on April 28 and charged
them with illegally selling personal identification information stolen from
bank and New Jersey state computer databases.
The police investigation alleges that a company called DRL Associates Inc.
was set up to find individuals and as a collection agency, but was not properly
licensed for those activities by the state.
A Hackensack man, Orazio Lembo, 35, has been charged with one count of
racketeering and eight counts of disclosing data from a database for his role in the
crime ring. Police allege that Lembo used his home as an office for DRL
Associates and that he had hired several upper level bank employees to access data,
including names, account numbers and balances, from the banks.
The bank employees worked for Wachovia Corp., Bank of America Corp., Commerce
Bancorp Inc. and PNC Bank NA. One of the other suspects is a former manager
of the New Jersey Department of Labor. 
According to police, after the information was accessed, Lembo and the
company then sold it to more than 40 collection agencies, law firms and others.
Police are now looking into the law firms and collection agencies that allegedly
did business with DRL.
Banking officials at Wachovia are notifying about 14,000 customers of the
possible identify thefts concerns, according to a spokeswoman.
Alexandra Liftman, a spokeswoman for Bank of America, said the bank hasn't
revealed the number of customers who may have been affected by the theft.
Liftman would only say that the bank has communicated so far with 75 customers whose
records were known to be accessed by the crime ring.
No suspicious or unlawful activity or fraud has been reported involving those
accounts, she said.
Fran Durst, a spokeswoman for Wachovia, said Hackensack police have so far
released the names of 300,000 of the 500,000 people whose information may have
been stolen. The Wachovia customers were among the 300,000 names released and
had about 48,000 bank accounts among them, she said. The customers have been
notified of the theft and are being placed on the bank's watch lists for fraud
detection, she said. "There have been no instances of identity theft
attributable to this," Durst said.
Brian Goerke, a spokesman for PNC Bank, said the bank has identified only 12
customers who could be affected by the data theft. "We've gone through the
lists, and those are all the customers on the lists," he said. "That doesn't mean
that their accounts have been tampered with in any way."
A spokesman for Commerce Bank couldn't be reached for comment today.
The ring had operated for more than four years, with Lembo's profits reaching
several million dollars, police said. Lembo, who was also charged with
narcotics, forgery and theft counts, faces up to 130 years in prison and $1.47
million in fines.

When dealing with collection agencies, the possibility that they may have some terrorist organization connections isn't the only threat one faces. There is an even greater threat the consumer needs to be aware of and it isn't necessarily the collection agency itself but rather the very real possibility that one or more of their employees may steal your sensitive information and use it or sell it online.

This Russian website deals in stolen credit information There are many more like that in cyberspace these days. These websites operate somewhat like ebay in that stolen information is sold to the highest bidder. All that is needed is your credit or debt card number or even your checking account routing and account numbers and that information can be sold on line and then used to purchase items on line.

We are now seeing more and more news stories about data bases of various companies being hacked and the sensitive information of thousands of people being stolen. This information is being stolen from banks, insurance companies and anyplace where large amounts of private information might be stored. The criminals always use fake webpages, proxy servers to hide their IP addresses and such things as the Dingo Anonymous Remailer which was recently used to spam 120,000 newsgroups to promote a false blog.

Spamming always generates large numbers of hate emails from those who have been spammed and those emails can be sold to yet other criminals such as those who promone the Nigerian scams and other forms of pfishing attacks.

Those email addresses can also be compared to the names and addresses of people who owe money and from whom collection agencies are trying to collect. So the reasons a collection agency hack might falsely pose as a consumer advocate are many and varied.
The tip-off is the use of proxy servers and other means to hide one's identity while trying to lure unsuspecting consumers to their website.

The bottom line is that it makes no difference at all whether they are somehow connected to actual terrorist groups or donate money to them or are looking for the email addresses of indebted consumers or might be gathering information about consumers for the purposes of selling the email addresses to scammers or whatever. One should never give a debt collector any information such as checking account or debit/credit card numbers. To do that is to open ones self to all manner of scams and frauds.

every known pfishing trick such as anonymous remailers, proxy servers and many more to gather private information about people for whatever illicit purpose the scammer might have in mind.

Today, even paying bills on line can be dangerous and get you into trouble. Creditwrench recommends that you never do that no matter how convenient it may be.

If you are going to pay a bill that you owe you should only do so by phone or by U.S. Mail and if you are going to pay a bill by phone be sure that you are the one who has initiated the call, not the other party.

Don't ever fall for paying a debt collector over the phone. You might regret having done that a lot. Make them give you a mailing address and then send them a certified bank cashier's check and never a check from your personal account and be sure to send it certified mail, return receipt requested. Be sure that you have photocopies of that check you send even if it is in partial payment.

If you are being bugged to death on the phone you can use these 18 questions to put a stop to it. They will put an end to harassing phone calls within 3 or 4 calls max. After that you won't be getting bugged to death by them anymore.

You should also learn how to pay off your debts the safe way. This method can only be used when paying them in full. If you have been making payments to a debt collector then you can use it on the final check you send them. If you attempt to use it to defraud them in any way then it will not work. If you are going to pay them at all then you need to have a means whereby they will have to take it off your credit reports instead of leaving it there for the full 7 plus years allowable by law or more if they can get away with it.

Improper Sexual advances by debt collectors

The following was found on a certain debt collector's forum today.

PERHAPS YOU SHOULD ACCEPT MY FREE OFFER TO COME TO PHOENIX AND LEARN ABOUT FEES, COLLECTIONS, UNIT YIELDS AND THE MANY OTHER THINGS VOID FROM YOUR RESUME'. ADDITIONALLY, YOU SHOULD COME EARLY SO WE CAN DISCUSS MY SEXUAL REQUIREMENTS.

Yet more proof that the collection industry is owned and operated by sickos and deviates who will stoop to anything. This blog has proven through references to major news media that some debt collectors have been accused by the government of aiding and abetting terrorism or engaging in activities that support terrorist groups here in the U.S. and overseas.

We have evidence from actual police files that debt collectors use "terroristic" means to collect debts from people. They threaten to burn people out of their homes if they don't pay up. They harass great numbers of people by means of incessant and abusive phone calls and other means and prey upon their ignorance of consumer protection laws put in place to prevent such abuses.
This is evidenced by numerous phone calls to CREDITWRENCH offices which have been recorded and put on various forums including the collection industry blog.

What kind of people are debt collectors in reality? Is that foreign sounding voice calling you about a debt some kind of terrorist? We really can't know that and we can't be guilty of discrimination either just because of someone's obvious ethnic background. After all, they may be just as loyal to America and deplore what is going on overseas just as much as you do. Regardless of their sex or sexual preferences, race or religious beliefs they may be just as willing to go fight and die if need be to defend our rights and freedoms as you are. So we can't very well use that as a reason not to pay. In fact, it isn't or shouldn't be about whether or not we pay because that has to be based on what one can or cannot do. A personal decision based on the circumstances of life and not upon beliefs or belief systems, religious or otherwise. We either have the ability to pay or we don't.

We already have more than enough laws in place that should control the actions of debt collectors so more laws are not likely to stop abusive debt collection practices. What is needed is a drastic increase in the penalties for breaking the laws we already have. Today we have no criminal penalties for most violations of FDCPA or state consumer protection laws. This author thinks that if debt collectors are found guilty of unduly abusing consumers then penalties should be in place to put the worst and only the worst offenders out of business.

In order to do that those who are employed in the industry need to be registered with the states just as are many other professions. Demanding an inexpensive license of them should help because then a point system similiar to that used in regulation of drivers can be put in place. Too many violations and you lose your license.

How can that be implemented? By calling your legislators at both state and federal levels and asking that more be done to control debt collectors. Suggest the idea of a point system so that those who are sooner or later identified as being abusers by virtue of too many complaints be forced out of the business. Suggest that it be made a criminal penalty to use any false name when contacting consumers.

Today most people have to go to great lengths to even find debt collectors whom they want to pay. Incredibly, every day hundreds of people are doing internet searches looking for debt collectors so they can pay up but can't find them. Why is that? Because debt collectors don't want you to send them their money. They want to call you by phone and badger you into paying by some electronic means because they get their money much faster that way. So they try to conceal what their address or contact information is even though the FDCPA says they must give meaningful disclosure of who they are and the purpose of their call.

We don't want to be reduced to having to sue them for their transgressions. Most of us would not willingly go into a court room for any reason, let alone go about filing all manner of lawsuits that may or may not win. When we are wronged we want the law to do something about it.

The only way to get that done is for enough people to call and write their legislators demanding that something much more meaningful be done to collar these criminals. So I urge you to find out who your senator and representative is down at the state capitol and give them a call in order to help stamp out abusive debt collection practices. You don't have to know a thing about FDCPA or FCRA or any other law to do that. All you have know is that abusive debt collection practices are an ongoing problem and you want something done about it.

SELMA, N.C. -- Police are investigating a New York collection agency, where an employee is accused of posing as a law enforcement officer to obtain payment on a debt.

An employee of Alden Associates called a 63-year-old Selma woman and claimed to be a Johnston County Sheriff's deputy, police said. The person ordered the woman to pay a $300 credit card balance from 2003 and said she would be thrown in jail in an hour if she didn’t, police said.

There's a suspicious letter you should see, because there may be one just like it in your mailbox.

And knowing what to look out for may keep telephone customers from paying a bill they do not owe. That's because some believe it's a bill of goods.

11 News obtained a copy of the bogus bill that investigators say is part of a collection agency scam.

Katherine Thomas usually picks up her mail when she gets home from work.

It was on her front porch last month while sorting through the bills that she came across a statement from a company that claimed to be a bill collector for Southwestern Bell.

"I was astounded to see a balance of $2,918.54," says Thomas.

Given their typical bill, which was $44 last month, this was the equivalent of six years of bills. And communication with the company was one sided.

On the other end was Bonded Collectors LLC, which listed its address as a P.O. box in Hopkins, Minn. and listed it operations address as a P.O. box in Largo, Fla.

It's hard to talk to a post office box, so she called.

"You can't get them on the phone. And you'll never get those people on the phone," says Thomas. "I wanted to bring this to the attention of the public. I don't know how many people have received these letters."

Officials with SBC Communications, formerly Southwestern Bell, say they've never heard of the collection agency.

Katherine Thomas knows they'll succeed.

"A bunch of little old people, senior citizens like us or older, will pay this. Cause this is what older people do. They get nervous."

And how much did Katherine Thomas pay them?

"Nuthin'."

Customers who receive a bill or telephone call like this should not make any immediate payments to anyone. If you're not sure you owe the money, don't pay.

A safe way to avoid this scam is to call the toll-free customer service number provided on a legitimate SBC bill and talk with a representative. Or contact the company by going to SBC.com.

CREDITWRENCH CEO Billie Bauer is obviously unable to provide a potential student with a simple yes or no answer. That should give some insight into whether one should consider paying him for any services. Or, better yet, the lack thereof.

Credit reair companies

So-called "credit repair" companies place ads in magazines, newspapers and on the Internet claiming that they can remove negative information from credit reports. The ads usually carry a version of this message: "Turned down because of bad credit? We can help!" These companies call themselves "Credit Advisors," "Credit Rating Correction Services" or "Credit Consultants." Many of these companies charge hundreds if not thousands of dollars to "clean up" bad credit reports. But the truth is, these companies can only do what you could do yourself—at no charge.

Nobody can remove negative information that is accurate from your credit report. No company has a "secret" ability to remove negative information.

But this doesn't stop these companies' claims. This deceptive quote is from a credit repair company brochure: "Charged-off accounts, collection accounts, judgments, tax liens, repossessions, and even bankruptcies can be removed from your credit records in less than one year (five to seven month average)."

One tactic is to bombard credit reporting agencies with requests to verify information. If a credit reporting agency cannot verify an entry within 60 days, it will remove the information from the report. But if the information is later verified to be accurate, it will go back in the report.

Before you even consider signing a contract with a company that promises to repair your credit, remember these facts:

* You may obtain a copy of your credit report on your own.
* You have the right to dispute entries in your credit report.

In any case, credit repair companies are prohibited under federal law from collecting any payment from you until after you get an amended copy of your credit report.

Never pay money to get your credit repaired. You can do it yourself for very little cost.

My office receives numerous complaints and inquiries regarding debt collection. Many consumers have been targeted by debt scams, while others are confused about old debts and whether or not they still have to pay them off.

One of the more prevalent frauds currently in circulation is the bogus debt scam. A number of consumers have turned to our office in confusion because they have received a demand from a collection agency trying to collect a debt that does not seem to exist or that they do not remember incurring.

It appears that some con artists often operate with little more than a post office box, and may hope that an intimidating letter will frighten a consumer into paying a small but totally bogus debt.

Whenever a consumer complains about an unexplained debt or charge, we immediately suggest the possibility that the consumer's identity has been stolen. We also recommend that you demand proof that an unfamiliar debt actually exists.

The best way to ensure a debt's validity is to check your credit file with the three major credit bureaus and demand documented proof from the creditor or collection agency. Legitimate lenders can readily produce a paper trail to show that a credit transaction actually took place. In a bogus debt scam, however, no proof can be produced that a debt even exists. You may also wish to contact the Secretary of State's Office to see if the collection agency is registered in Texas.

We also receive inquiries regarding the obligation to pay old debts. If you never paid off an old debt, that does not mean it is not valid; you are obligated to pay it even if it has been several years since you were contacted by a collection agency or the business you owe the debt to.

Many consumers are under the impression that after a certain number of years, they are no longer responsible for an unpaid debt.

Under Chapter16.004 of the Texas Civil Practice & Remedies Code, Four-Year Limitations Period, the statute of limitations for filing suit to collect a debt is no later than four years after the cause of action accrues. An example of when the cause of action accrues is the date on which the debt is declared to be in default.

Under the case law related to this statute, debt means any outstanding liability payable in cash. In addition to consumer loans or credit card debt, this can mean a tax liability, damages related to land sale fraud, overpayment or underpayment of royalties or wages, money allegedly owed under an insurance policy, and money arising from a breach of contract.

The fact that a creditor is barred from collecting a debt through a lawsuit due to the statute of limitations does not mean the debt is erased - the debt remains in effect, and the creditor can still use other means to try to collect it. And the debt will remain on your credit report

Also, most of the cases cited involve unsecured debt, where the suit would result in a personal judgment against the debtor. There are different rules for debts secured by property, such as mortgages. You may wish to consult with a private attorney if you are unsure which type of debt is involved or what options are available in resolving it.

Correctly deemed the worst-type of collection agents! They operate from a computer database that contains all of the information regarding you, provided to them by the original creditor. When an outside agency gets your account, it has been 'charged-off' for non-payment. They make more then 200-250 calls a day and the name of their game is also... $$ MONEY $$!

An agency collector receives a commission averaging from 15-25% of what they can collect. Most are paid bonuses if they hit a quota and a good, hard-working collector can make $40-60K per year. However, most collectors are fortunate to make half of that amount. The problem is that the majority of them (70-80%) routinely step over the line to increase the monetary rewards of their actions. The debt collection business is plagued with a huge turnover in employees and by that nature, is a largely transient industry. Unfortunately, far too few consumers complain enough about debt collectors stepping over their bounds, usually because they are intimidated and embarrassed about their dilemma. It has been my experience that the average debt collector is male, has a large ego, bounces around from job to job, have a lot of debt themselves, suffer from low self-esteem and enjoy using the telephone as an instrument of empowerment. Collectors see themselves in a position to take advantage of those they deem weaker, in an effort to overcome their own insecurities. They normally will talk-over any issues you may have, threaten and intimidate you, lie, misrepresent themselves, abuse, annoy and attempt to push you as far as they can if the rewards to them of self-gratification and money are realized. The spectrum of collectors I've encountered over the years, in dealing with literally thousands of them have ranged from the low percentage of honest and hard working (20-30%), to the average of deadbeat scum that is either just out of, or heading back into a jail cell (70-80%). Collecting is male dominated and because of the shortage of skilled workers, agencies are hiring anyone who can walk and chew gum to make their calls. Social skills, education and career orientation are NOT normally the prerequisites for a debt collector – money beggar position.

From standard phrases such as: "what is your intent" to "I'm going to recommend that our client take immediate legal action against you." The innocent unsuspecting consumer feels threatened and even terrorized by the antics of terrorist debt collectors. The really bad ones will call you at work, violate third party disclosure, or worse, in order to intimidate or threaten you with arrest or wage garnishment if they don't have the money today! They persuade you to pay off old debts using your new credit card, via Western Union wire transfers, bank drafting, debit checks and cash. They will tell you your credit report will be clean and your soul will be saved fro hell, (halleluiah!) if you just send them the.... $$ MONEY $$. The National Consumer Law League, (NCLC) and the National Association of Consumer Advocates, (NACA) assist attorneys across the country in pursuing agencies and collectors who violate the law and your rights. Collectors are learning that the phone name they use and the perceived anonymity of hiding behind a telephone can easily be overcome with the modern technology of today and investigative techniques. Some collectors are learning first-hand that they too, can be charged with making threats over the phone and that their employers do not provide bail money, or legal representation as a perk. Creditors are increasingly becoming less tolerant of agencies that allow abuse and will drop those that don't comply. I urge you to complain about collector abuse by contacting the FTC, the American Collectors Association, the original creditor and your state bar association (against attorneys), or myself if you feel your rights are being violated. There is a nationwide group of professional consumer attorneys, skilled in debt collection laws that passionately defend the rights of consumers against these illegal collectors. No consumer should ever suffer abuse from a debt collector, the laws WILL protect you!

Alleges Company Falsely Advertised "Low and Fixed" Rate Credit Cards

Minnesota Attorney General Mike Hatch filed a lawsuit today against
Capital One Bank and Capital One F.S.B. for using false, deceptive
and misleading television advertisements, direct-mail solicitations,
and customer service telephone scripts to market credit cards with
allegedly "low" and "fixed" interest rates that, unlike its
competitors' rates, will never increase. In fact, the lawsuit alleges
that Capital One increases the interest rate on such cards up to 400%
for consumers who trigger a "penalty" rate by defaulting in any
number of ways.

"Capital One aggressively markets its brand image as the credit card
company with the nation's lowest fixed rates," Attorney General Hatch
said. "But that image is false. If you do something as simple as pay
a day late, your rate with Capital One can sky-rocket overnight."

The State's suit alleges that Capital One uses "penalty rate" pricing
to offer a supposedly "fixed" interest rate to consumers, but then
increases that rate when an individual account holder defaults.
Capital One also retains the right to unilaterally increase an
account holder's interest rate--for any reason or no reason at all--
based upon a "change in terms" provision in its credit card agreement.

Specifically, the lawsuit faults Capital One's marketing practice as
follows:

• Television Ads : Capital One runs television ads with the same
basic format, script, graphics and visual punch line designed to
create the false and deceptive impression among consumers that its
competitors' rates will increase, but Capital One's rates will not.
In Capital One's "No-Hassle" ads, for instance, two people compete to
pay for lunch, one with a competitors' card, the other with a Capital
One card which has a "low and fixed" rate. When the man with a
competitor's card asks what's going to happen to his rate, he is
physically shot upward by a catapult operated by barbarians or a
breaching whale. Capital One then orally and visually tells consumers
that it offers the nation's lowest fixed rate at 4.99%.

• Written Solicitations . Capital One bolsters its false television
ads with deceptive direct mail solicitations. In one solicitation,
for instance, Capital One describes its 4.99% interest rate as "low"
thirteen times and as "fixed" seventeen times, including on both
sides of the envelope, in the body of the text, in the application
itself and elsewhere, including boxes comparing the interest rates
and "savings" of Capital One's credit cards with consumers' other
loans.

• Customer Service Scripts. When consumers contact Capital One to
apply for the card, Capital One scripts its customer service
representatives to evade a direct response to the question "What does
fixed mean?" Capital One answers: "Unlike most credit card companies,
Capital One's fixed rate is not variable and will not go up and down
as interest rates change." Only if a consumer "probes" another two
times does Capital One concede that it cannot guarantee that its
rates will stay the same forever.

Filed in Ramsey Country District Court, the State's lawsuit alleges
that Capital One's marketing practices violate Minnesota's laws
prohibiting false advertising, consumer fraud, and deceptive trade
practices. The suit seeks injunctive relief prohibiting Capital One's
false, deceptive and misleading conduct and civil penalties.

The defendants are Capital One Bank and Capital One F.S.B. Both are
Virginia-based entities that offer credit card products to prime and
subprime consumers. Capital One is one of the top ten largest credit
card issuers in the United States. According to Capital One Financial
Corporation's most recent Form 10-Q filing with the U.S. Securities
and Exchange Commission, Capital One's domestic credit card loans
totaled $46.1 billion as of September 30, 2004. These loans generated
net income of $414.4 million for July, August and September, 2004, a
50% increase from the same period in 2003. Capital One's marketing
expenses were $826.6 million from January through September, 2004.
Capital One's solicitations claim that the company has 46 million
customers.

My 12 year old son recived a phone call from a women who gave him the impression that I was owed money in the form of an award, and I could claim it when I returned her phone call. Knowing that I am not owed money by anyone, I started checking the phone book, internet, google, and your pages. Sure enough, the collection agency is Forster & Garbus, I found them on Google. Thanks for your information

That is about like the old police sting where they advertised in newspapers saying that a contest was being held by some company and anyone who could properly answer their prize question would receive a free vacation. People would show up, fill out an identification form which would be quickly checked by police in a back room and if they showed up as wanted for something or other they would get their vacation as promised. However, in the case of the collection agency doing much the same thing, they are violating the FDCPA by giving false and misleading information to consumers and can be sued for that. Sounds like it might be a good candidate for a class action lawsuit and I just happen to know a lawyer who is looking for reasons to file class action lawsuits on debt collectors. You have absolutely no possible way to have any impact at all on my target audience, no way at all to influence those who attend my seminars, no way to have any effect whatsoever on me or my marketing. You are totally powerless and you always will be.

You spammed 120,000 newsgroups and now have only about 2 or 3 real listings anywhere and your spam is slowly getting purged from the engines. That trick got you almost totally banned from the search engines and you won't get back in them anytime soon.

Name calling, false allegations dreamed up out of thin air or statements taken out of context and twisted to say whatever the clown thinks will be funny or damaging, stealing of trade names for the purpose of smearing and defamation of another, any low down trick that can be used is the hallmark of the lunatic who has nothing better to do with his time than to smear, make fun of or harass another. But one way to judge whether or not to believe the cybersmear is to see how much personal character the poster has. What has he himself done? How pristine is his conduct that would keep his own actions above reproach and therefore believeable? Let's take a look at the present clown. Cartman falsely claims he don't own the blog he keeps putting up links to. He claims he only refers to it as being his source of authority. So then if that be true what we need to do is to look at his source of authority to see what it's character might be. One place to look might very well be the terms and conditions his reference blogger agreed to when he signed up for his blog. Here is an exerpt from the blogger terms of service.

So, the evidence is more than sufficient to prove that the blogger that Cartman praises is in flagrant violation of the blogger terms of service agreement he agreed to when signing up for his blog. Obviously then Cartman condones that kind of behaviour.

He keeps hollering about my services or what I sell but I have not attempted to sell anybody anything except the fact that I believe that debt collectors are scumbags who routinely abuse people and that much more restrictive and punitive laws should be passed to bring them under much heavier restrictions and sanctions for abusive debt collection practices.

Cartman cannot argue that debt collectors do not routinely break the laws as a normal business practice because far too many people know better. Since he cannot beat the argument that I make he turns to personal slams to do that which he cannot otherwise do. By turning to such personal slams as he has he simply proves my contention that debt collectors are scumbags.

If he wants to bring in personal slams then he needs to make sure that his own actions are above reproach.

Cartman, your ideas of "classic hovel" aren't any better than your ideas of personal integrity.
One simply cannot put large numbers of computers and their peripheral equipment such as monitors, routers, hubs, switches, printers, scanners, UPS systems, security monitors and cameras and more into a pre-existing older building without having wires and cables running all over the place unless you completely and totally remodel the premises.

The topic of conversation here is not me or what I do but rather scumbag debt collectors and their illegal and abusive debt collection practices. Why is it that you cannot or will not stay on topic? Nobody cares about all the things you keep dragging up. Nobody cares what I do or do not sell. Nobody cares what I look like nor what my office looks like. Of course, in his next post he will rant and rave about how you should never click on any link that I provide because that will likely give you a virus and even if it don't the link will be full of false and misleading information. He emphasizes that by the fact that his cybersquatter webpage which is hosted on godaddy.com and that is where my webpage is also hosted. So much for that false and misleading claim of his.

To top it all off, the link above is not to a personal webpage but to a search engine that will tell you exactly what is being said about Uncle Normie and his army of false and misleading screen names.

He is so brainy that he thinks that spamming 120,000 newsgroups will get him lots of links but what he don't know is that he is fighting a virtual buzzsaw that has a huge headstart on him. He has no idea how to use even such rudimentary things as meta tags , let alone how to use API calls and other types of automatic feeds, he has no idea about how to use page ranking, no idea about how to do SEO, no idea about how to use blogs to do his posting, no idea about how to use audio posts or how to do his own video posts. In fact, the only thing he knows how to do is how to cybersmear and how to spam 120,000 newsgroups feeding them all the same false and misleading information.

In contrast, let us see what others have to say when we check the same search engine for the term CREDITWRENCH.

What debt collectors don't tell you.

While it isn't their job to educate the public there is one rather nasty little surprise that debt collectors don't tell you about. If you settle the debt for less they can and quite often do report the unpaid balance to the IRS via the 1099 form and especially if the difference between what you originally owed and what you settled for is large, over $600. Then you can be required to pay the tax on the the difference they reported. If you don't report it and pay the tax on the "income" then you incur the possibility of getting into deep problems with the IRS. But they never tell you any of that but usually let you find it out the hard way because if they did tell you that then you might not pay them at all and of course they couldn't stand that.

And another thing they don't tell you is that if you dispute the debt and can prove that you just might not have to pay the IRS at all because accoriding to what I have read IRS may not collect taxes on a debt which has been a subject of dispute. Now then, since I am not an IRS expert I would recommend that you use what I am saying about that and do your own research. And that is something I always teach. Never believe anything you read or hear about until you have done your homework and know for a matter of fact that what someone has told you is true and correct. In this type of situation ask a competent tax attorney or an accountant because they probably can tell you the truth of the matter. One author has posted the following which is what prompted me to write this article.

The debt-discharge surprise
Congratulations again! You convinced your credit card companies that, unless they reduce your debt balances, you’re going to file for bankruptcy, and they’re going to get nothing. They generously lowered you liability by $5,000 so you can pay off the balance over the next 24 months.

Here’s the nasty surprise: That $5,000 reduction is now ordinary income to you and could cost you as much as $1,750 in additional income tax -- if you're in the 35% bracket in 2004 and 2005. So much for getting your cash flow in order.

Unless it was sheltered by the umbrella of bankruptcy, debt reduction represents accession to wealth, clearly realized, and it is considered taxable income.

So the correct answer to a debt collector is to demand that they prove that you owe the debt even though you know that you do. Why? Because the Fair Debt Collection Practices Act says that you have the right to dispute the debt or any portion thereof and the debt collector is the proper person (company)to demand that of. Make them prove that you owe the debt and give you the opportunity to dispute the debt or some portion of it if you choose to do so. The law says they have to provide you with that information and your failure to demand that they do could lead you into a huge tax liability you were not prepared to deal with. So above all, dispute the debt before paying so they have to prove you owe it. Establish your dispute if at all possible.

So the next question might be does their failure to disclose the fact that they will file a 1099 on the unpaid balance constitute an Unfair Deceptive Practice? It MIGHT be.

How about a failure or refusal to provide you with the documentation you would need to dispute the debt or any portion thereof? That might be a violation of FDCPA and it MIGHT also be deemed to be an Unfair and Deceptive Practice. You MIGHT want to check your states UDAP laws to find out and then consult with a competent attorney who MIGHT be able to represent you in a lawsuit against the debt collector who is hounding you to death.

Concerned Citizen has just been kind enough to provid me with a link to one of his 120,000 spam messages which he falsely claims he didn't do. I have pretty well cleaned up most of the more offensive language the other members of the newsgroup used in telling him what they thought of him and his spamming of their news group. Had they been able to get a physical hold on the louse they probably would have used something a bit more forceful to teach him that they don't appreciate his looney tunes antics either. Why he was so dumb as to deliberately point me to what I already knew about I don't know but since he did that is now his problem.

Of course, spammers, liars or cybersmearers are never too smart to begin with.

Spinning through the dark dingy center of his/her empire, MayMay began to woolgather thinking of a wonderful time at a special cantina in ole Mexico.

The shrill feedback shocked the senses and rattled the acrid smoky air of the old bar in the crappier section of TJ. “Testes Testes Uno Dos Tres” said a short man in the center of the stage, mildewed torn curtains behind him, micorphone stand 3 feet off the stage,.“Buenos noches amigos” said the MC a dwarf with a club foot wearing a suit he should have abandoned 20 pounds ago. “Hwelcome to our chow” He grinned a piece of spinach lodged in his yellow bicuspid , his full slicked back hair radiant with the spotlights, “ Tonight our Chow ees called “The Bride of the Burrrrrro”

The donkey’s brays could be heard back stage, but it was the sheep’s bah that drew Phil’s attention.

“Hwe need a volunteer amigos to romance DULCITA! At that the spotlight shown on a young lamb wearing a push up bra and “Hanes for Her” probably purchased at a store for muchachas grandes.

Phil was drunk enough and the lamb looked hot, what the hell he thought and throwing caution to the wind he arose and walked toward the stage as a group of sailors on shore leave began to chant “Do It!”

Stumbling out the rank saloon, Phil steadied himself if only to avoid the rain of fists that would befall him if he neared the sailors. The room which previously smelled of sweat, beer, cigarettes, despair, cheap perfume, and livestock now reeked in a twisted potpourri of the previous now spiced with gore and cordite. (Ed Note- Foxy what a twist)

Death awaited the depraved pervert if he stayed a moment longer. His breath smelled like a jet of Binaca sheep scent. A toothless old prostitute spat at his face which only made him grin. He loved this town. His desires unsated he entered an S and M bar next door. "La Painadoria"

Inside a butch bull dike with a leather Nazi officer cap sneered as he entered his eyes now adjusting to the low light. Suspended from the ceiling by his nipples pierced by talons a la Richard Harris in "A Man Called Horse", hung a young man of Phillipino descent spinning in slow arcs. Ordering a cheap beer from a one-eyed waitress, Phil got comfortable and took in the spectacle around him.

CREDITHAMMER relaxed as he took in the scenery. He wasn’t aware of the sailor who had walked in a few minutes later.

The Sailors had watched him as he sulked away from the cantina and snuck into the LaPainadoria. They were talking about what they would like to do with the mean old fool when a young sailor had arrived late on the sceen. He was late, but his buddies filled him in on what had happened.

The particular sailor was from Northern California.

He grew up on a farm which raised sheep for their wool. He had many a lamb as a pet.. He considered them friends. He loved animals and detested the idea of anyone mistreating them. It broke his heart when they told him what had happened.

He was happy to hear that the burro had managed to knock out the MC and push CREDITHAMMER down, before CREDITHAMMER had shot him to death. He swelled with pride for the burro.

He despised the cruel man who had shot the burro and the lamb. He loathed CREDITHAMMER for everything that he represented.. He wanted to revenge the horrible death of the two poor innocent animals.

He was enraged.

The sailor thought that his buddies had described the brutal old man well. He spotted him immediately, snickering over a drink and laughing at something. The ‘something’ was a poor helpless young man who was suspended from the ceiling and spinning in low arcs. He could not believe his eyes as he realized that the young man had talons hooked into his flesh. The young man was desperately pleading for someone to help him.

The sailor immediately jumped onto the bar and with his Swiss army knife swiftly cut the young man down. The young man fell to the ground and cried “Thank you. Thank you.. these freaks are crazy.. help me.. help me.. please help me get out of here”. The sailor was in the process of helping the young man up and telling him that everything was going to be okay, when all of a sudden the bull dike with the Nazi officer cap approached them and said “What the hell do you think you’re doing here”?

The sailor could not bear the sight of the bull dike with the Nazi cap. He could care less about her sexual preference, but he would not tolerate anyone wearing a Nazi cap. He had read “Ann Frank” several times while at school, and had great sympathy for all of those who had suffered at the hands of the hateful Nazis. He walked toward her and quickly grabbed the cap off of her head and tore into pieces, and threw them into her face.

The woman shocked.. started screaming obscenities and proceeded to lash out with her big fists in a futile attempt to beat up the sailor. The young man who was cowering behind the sailor had started to scream. The sailor pushed the big woman down and picked up the young man and ran out of the bar with him.

Throughout it all the vile CREDITHAMMER sat in audience. He was thoroughly disgusted with the sailor for interrupting his fun and spoiling what his sick mind considered to be his entertainment.

But some freak intuition of his own told him that he had lucked out.. told him that the sailor had actually come into the bar for him.. told him that if it had not been for the sailor’s timely rescue of the poor tortured soul suspended from the ceiling, it would have been he himself who would have been carried out of the bar.

He was moping about the unbelievable bad luck he was having that day, as he crept out of the bar of ill repute..

The phone rang, bringing him back to the present. Still dressed as MayMay69 Phil couldn't pick up the phone. 6000 visits to his website and not one sale. These idiots didn't know what was good for them. Pensively, he looked up the blog of his arch Nemesis, C. Tormis. Filled with a combination of dread he waved his arms above his head dreamily, like Bette Davis in "What Ever Happened to Baby Jane?" Dancing around the room he turned on his VCR. Richard Simmonds was flouncing and dancing with a crew of whalish housewives. An idea brought forth its own genisis in the surviving neurons in his cranium. "That's it!" "The Credithammer DVD!" He envisioned himself on commercials like the guy that wears the suits with question marks like the Riddler that sells books on getting government grants. I will make a video and at that he danced dervishly like Richard Simmons on amphetimines.

But before I can begin production, Phil proclaimed, I must continue to try and find all the newsgroup postings about me and respond to them like I did yesterday here. Rats, more people finding out the truth about me.

CREDITHAMMER searched stealthily through all of the newsgroup

postings and responded to them as quickly as possible..

He hated C. Toris with every fiber of his being. He couldn’t help the tears that were falling from his eyes and messing up his cheap mascara. As he wiped away the tears, he thought.. “Darn, This guy is going to put me out of business! How can I scam unsuspecting people.. and rip them off with my mis-informed credit advice, when C. Toris is telling them THE TRUTH about me? And how am I gonna get any money from these gullible and trusting people with my fire scam, when C. Toris tells everyone THE TRUTH about it all being a bogus ploy to pilfer money from them"?

CREDITHAMMER resigned himself to yet another task of systematically typing ridiculous and irrationable responses, hoping to salvage himself another "student"..

He climbed into the Ford Pinto, avoiding jagged metal and peeling faux wood trim. He was on his way to Best Buys with one of his two remaining lines of credit. His Mowes card long since toast, but he had that secured Cap One card and a man on a mission would get some fancy AV equipment and voice recognition software with that Best Buy plastic. He envisioned the CreditHammer(TM) program with his face as the spokesman as being a surefire hit. MayMay69, Jeffe, Wagg, and Goosegow1 would certainly want to be in the film. That Jeffe needed to be on a shorter tether by cracky, Phil was alarmed by the Jeffe since he started getting instructions directly from God spoken to him through cats. Entirely different matter.

He pulled in to the first handicapped spot. Not that he was incumbered in any way, he just didn't give a crap. He grinned big thinking of what was to come.

How Cybersmearers Amplify Their Message **

The perpetrators of Cybersmear (or what is referred to as Internet Terrorism), are prone to predictable patterns. Most common among these is the strategy of amplifying a complaint or several accusations in an attempt to lend credibility. This is done largely through what we call “proliferation and amplification.”

The goal of an Internet Terrorist is to inflict harm on the target company or individual. This is done through what must seem to be credible information that also must appear to be large and prevalent.

Here are the consistent tactics of Cybersmearers on-line:

• Anonymous postings on scattered “chat rooms” and/or bulletin boards.
• Look for postings chronicling the “injustices” of the accused company in what appears to be detailed “bashing” or techno-discussion. Look for (amateur, unlicensed) interpretation and conclusions.
. Look for information or quotes taken out of context from the accused, or represented in very small segments as to be presented in a more misleading manner.
• With very few exceptions these basher will claim a concern for “innocent victims” or the “unsuspecting customer”.
• With few exceptions these bashers will claim a “neutral” stance, but will solicit either comments or emails which will predominate in the direction of the Smear (this is key to identifying a smear. True neutral discussions open to the public generally occur with both positive and negative viewpoints equally represented. If the balance is tilted too far in one direction, it is the fingerprint of a smear, and the posted comments can safely be considered false).
• It is common for all of the comments to be anonymously posted by the perpetrator(s) to create the sense of “unified outrage” or “a virtual stampede of individuals who agree” or “surprising public outrage” (all actual quotes).
• Further, perpetrators will anonymously post slightly varying opinions (all in the direction of the smear, of course), so a “discussion” can occur on finer points of the smear, all the while creating the impression of a larger complaint field.
• Among what is usually a small circle of smear perpetrators (generally ten or less individuals behind the largest and most famous smears), automatic posting notifications are sent out whenever one individual places new content on the Internet. This allows the others to rush to the scene with their anonymous postings, again, providing amplification and a false impression of the scope of the complaint.
• The band of smear perpetrators will carefully interlink their sites (to a controlled result, over linking is punished by search engines) so that their websites receive high ranking in search result pages.
• Key words, many times the company or personal name of the accused, will be used in the bashing of titles, body of text, and Meta tags so that someone searching for the accused will automatically find the Cybersmear websites. In this way, the smear is made known to those searching for the accused company or individual.
• The smearer’s strategy is to accomplish the following in the mind of the reader: “I didn’t realize all of this about (company or person). I wouldn’t normally believe it, but there is so much of it on the Internet. If it’s that prevalent, it must have some truth to it.”

Cybersmear perpetrators have simply followed the historical basis of telling lies successfully and applied it to the Internet.

Adolph Hitler said, “The longer you tell a lie, the more people will believe it.”

Our Cybersmear enemies know this strategy well, and they will use the above tactics of “amplification and proliferation” to achieve it.

Folks, the list of spam messages this joker puts out is absolutely endless. More than 120,000 of them and still we keep on getting more from this spam monkey. The best I can do is try to make everybody aware of his false and misleading posts and information and let him ruin every message board, newsgroup, egroup and the entire web with his garbage.

He is in violation of every terms of service agreement he ever agreed to and is in violation of the United States Code that is called the Computer Decency Act or CDC and one of these days they will catch up to him and put him behind bars where he belongs.

Why do debt collectors fear the truth? Because if everybody understood what happens when you pay them they woud never collect a crying dime. They will never give a receipt for any money you pay them and that is because the money they get cannot be easily traced or tracked and it is much easier for them to steal from their clients, turn the debt over to another collection agency who will attempt to collect from you again even though you paid the debt already. They also will be less likely to get caught at their thievery. But that is why most states have licensing laws in place to help protect the creditors who trusted them to collect the money.

Debt collectors will never take it off your credit reports either. Makes no difference whether you pay them or not. So never pay a debt collector thinking that is going to help your credit ratings. While it might give you a very small boost because your debt to income ratio will be improved that won't overcome the negative effect of having debt collector skunk spray all over your credit reports.

But he soon found out that the Oklahoma Court of Criminal Appeals had ruled against him in the case of Priddy v. City of Tulsa.
